ASOTIN — A Clarkston man facing charges stemming from a police encounter after his shift ended at Walmart now has a trial date on the court calendar.
Mark A. Domino, 52, made his third appearance in Asotin County District Court on Tuesday afternoon before Judge Tina Kernan. His case was continued to 3:30 p.m. Aug. 21, and a two-day trial was tentatively scheduled for Oct. 3-4.
Domino is charged with resisting arrest and obstructing a law enforcement officer after allegedly refusing to provide identification to police as he walked to his motorcycle after work. The police were investigating a possible vehicle prowl June 24 when they asked Domino for his ID and detained him.
During the encounter, which was captured on cellphone cameras and posted to social media, Domino was subdued with a stun gun and handcuffed after allegedly refusing to comply with orders. The defendant, who is representing himself in court, has pleaded innocent and wants the case dismissed, saying he did nothing wrong.
Prosecutor Todd Richardson, who pursued the misdemeanor and gross misdemeanor charges, maintains the alleged crimes were committed, and says he can prove it at trial. He has offered Domino a plea-backed deferred prosecution, which was refused.
On Tuesday, Richardson told the judge he would need some time to review the new motions Domino filed Tuesday, along with a thumb drive provided by the defendant.
Kernan said Richardson must file any responses to the new motions by Aug. 7, and Domino will have until Aug. 16 to file his counterpoints to the prosecutor. The judge will hear all of the motions Aug. 21, including Domino’s requests for a change of venue and dismissal, and Richardson’s motion to establish probable cause.
