Lewiston man accepts plea deal on child abuse charges

A Lewiston man has accepted a plea agreement after reportedly burning a 5-year-old child with a methamphetamine pipe and recording the child performing sexual acts on another child.

Donald K. Damon Jr., 30, pleaded guilty Friday to sexual abuse of a child under the age of 16 and injury to a child, both felonies. He is set to be sentenced April 27.

Damon was arrested in November after Lewiston police received reports of child abuse from a relative of the two children. He initially tried to flee police when they attempted to speak with him at a mobile home on the 600 block of Warner Avenue, where he reportedly stayed with his girlfriend. He was found hiding under a recreational vehicle parked on the 3200 block of Sixth Street D, according to police.

Damon reportedly told police he had been overly rough with one of the children, according to court documents. He said the pipe burn on the child's calf was two weeks old and was caused by the child accidentally touching it. Police later found photos and video on Damon's cellphone of the children performing sexual acts.

Damon initially was charged with three felony counts of sexual abuse of a child and one count of injury to a child. As part of the plea agreement he accepted Friday, two of the sexual abuse of a child charges were dropped.

State prosecutors will recommend a sentence of five to 20 years in prison for the charge of sexual abuse of a child, and five to 10 years in prison for the charge of injury to a child. The state recommends the sentences run concurrent, according to the plea agreement.

Sexual abuse of a child under the age of 16 carries a maximum penalty of 25 years incarceration and a $50,000 fine, and injury to a child carries a maximum penalty of 10 years in prison and an additional fine of $50,000.

Damon will be sentenced before Judge Jay P. Gaskill. He is being represented by attorney Paige Nolta. Chief Deputy Prosecutor April Smith is handling the case for the state.
